Instigated bankruptcy cases refer to enterprises, corporations or natural persons which have filed for bankruptcy during a calendar year. The instigation of bankruptcy proceedings does not always mean an enterprise or own-account worker “goes under” in the actual sense. Bankruptcy as a trial is a complicated legal process involving several stages, in which proceedings may be interrupted at different stages.

Filing for bankruptcy was limited by fixed-term amendments to the legislation between 1 May 2020 and 31 January 2022. The legislative amendments have limited the possibility of a creditor to file a bankruptcy petition against a debtor. In the data of the statistics on bankruptcies, it is impossible to separate the possible impact of the legislative amendment on the number of bankruptcies from other possible factors, such as independent actions of the Tax Administration or other creditors.
