1. Scope of the terms of use
These general terms of use are applied to access rights concerning Statistics Finland's chargeable statistical databases, unless otherwise agreed in the agreement concerning access right.
2. Fees
The fees for the services provided by Statistics Finland are based on the decree of the Ministry of Finance valid at each time concerning the charges payable for the services of Statistics Finland (see stat.fi/en/services/charging-basis-and-prices). Payment is due 21 days from the date the invoice was delivered. Statistics Finland has the right to collect lawful interest on arrears for the period of delay in payment. The Value Added Tax Act (1501/1993) is applied to Statistics Finland's services. Should some change occur in a tax or some other public charge related to the order, Statistics Finland has the right to change the prices accordingly.
Statistics Finland has the right to review the prices of continuous agreements by notifying about it in writing at least 60 days before the change takes effect. The orderer may cancel the agreement to end on the date of entry into force of the change by notifying about it at least 30 days earlier.
3. Nature of access right
The orderer receives a limited, non-exclusive and non-transferable access right to the database as agreed in the agreement. The access right entitles the orderer to use the database for the duration of the agreement. The access right does not indicate a transfer of ownership of the data material contained in the database.
4. Special conditions for the orderer
All rights to the database and the data material it contains, copyrights included, belong to Statistics Finland. When releasing data based on the material, Statistics Finland and the name of the database must be acknowledged as the source.
Unless otherwise agreed, the orderer or the parties acting on its behalf do not have the right to release, publish, resell or commercially utilise the data or parts of data. If the orderer or the party acting on its behalf releases, publishes or otherwise uses the database or the data material it contains in violation of the terms of agreement, Statistics Finland is entitled to impose a contractual penalty of EUR 5,000 on the orderer.
The orderer ensures that all parties using the database on its behalf are aware of the terms of use. The orderer is responsible for all misuses through their user ID as for their own. The user ID must not be handed over to third parties.
5. Special conditions concerning Statistics Finland
Statistics Finland maintains the database, produces the data material it contains and is responsible for the data being in accordance with the original data sources. Statistics Finland has the right to suspend access to the database temporarily if this is necessary for reasons related to the functioning of the database, technical changes or other similar reasons.
Statistics Finland accepts no liability for errors or delays caused by interruptions or faults in central government’s ICT services or other software, information systems or data communications provided by a third party. Statistics Finland accepts no liability for delays in updates of the data material when such delays result from delayed delivery of statistical data from third parties.
Statistics Finland is not responsible for any indirect damages nor errors or delays caused by force majeure. The liability of Statistics Finland is limited to the price of the access right excluding damage caused wilfully or out of gross negligence.
6. Contact persons and data protection
Statistics Finland processes the personal data of the contact persons in order to fulfil the obligations of the agreement and for invoicing purposes. The information is stored in Statistics Finland's customer and stakeholder register, the data protection description of which can
be found at stat.fi/meta/tietosuojaselosteet/tietosuojaseloste_asiakassuhderekisteri_en.html. Personal data are processed according to data protection legislation. Changes concerning the contact person must be reported by the orderer in writing.
The Act on the Openness of Government Activities (621/1999) is applied to Statistics Finland's documents (e.g. agreements).
Statistics Finland does not release data the release of which would breach the statutes on data secrecy.
7. Termination and cancellation
of the agreement
The parties have the right to terminate the agreement by a written notice 30 days earlier.
A party has the right to cancel the agreement if the other party violates any of these terms and has not redressed the violation within 30 days of a written notice. If the neglect or other violation of the agreement is material, the other party has the right to cancel the agreement immediately.
When the agreement is cancelled, Statistics Finland is entitled to receive full compensation for any services it has performed under the agreement.
8. Changing the terms of use
Statistics Finland reserves the right to change the terms of use. If any changes are made to the terms of use, this is notified in writing 60 days before they enter into force. The orderer may cancel the agreement to end on the date of entry into force of the change by notifying about it at least 30 days earlier.
9. Validity of access right
The agreement will enter into force when the orderer has signed the agreement form. The access right is valid for the duration of the agreement.
10. Settling of differences
If any disputes arising from this agreement cannot be settled through negotiation they will be settled by the Helsinki District Court.
